New judiciary law will entrench justice

The new judicial law in the emirate of Abu Dhabi will help entrench absolute independence of the judiciary and upgrade its performance in the service of justice, state's rights, rights of nationals and residents as well as stability and security of the local community, affirmed Sheikh Mansour bin Zayed Al Nahyan, Minister of Presidential Affairs and Chairman of the Judicial Department in Abu Dhabi.
'Judiciary in our country is an independent authority and no power dominates over the judges except their vigilant conscience and rule of law. The political system derives its legitimacy from the fair and efficient justice,'' Sheikh Mansour said in remarks on the occasion of issuance of the new legislation.
Sheikh Mansour added that the law, issued by President H.H. Sheikh Khalifa bin Zayed Al Nahyan, in his capacity as Ruler of Abu Dhabi, in 2006 for re-structuring the judicial department of the emirate of Abu Dhabi, was part of an overall reforms drive covering various domains in the country.
He urged members of the judiciary to reinforce the principle justice and equality as a due guarantee for all members of the community.
The new law is an embodiment of the vision of Sheikh Khalifa and General Sheikh Mohammed bin Zayed Al Nahyan, Abu Dhabi Crown Prince and Deputy Supreme Commander of the UAE Armed Forces, for building a developing, effective government in the emirate.
The law No 23 of 2006 created a Judiciary Council to be headed by Chief of the Cassation Court. The new council shall consider all promotions, delegations and secondments of Abu Dhabi judges. It will also have its say in draft laws pertaining to the judiciary system and public prosecution.
The new law also creates new courts of instance, courts of appeal and courts of cassation.
According to the new law, the newly-created courts of first instance shall include civilian, commercial, penal and criminal sections as well as sections for personal status affairs.
The Judiciary Council shall also be consulted on the creation of the said sections.
The new law sets in detail the required qualifications of judicial staff.
The law created a new "Judicial Department" to be part of the Abu Dhabi Ruler's Court. The new department shall have the authority to create courts of the first instance in the emirate of Abu Dhabi. A new Executive Department shall be affiliated with the Judicial Department and shall be responsible for executing verdicts and issuing judicial notifications.
The Judicial System shall also include the new "Judicial Inspection Department" to be affiliated with the Judiciary Council to inspect scrutinize performance of judges and the prosecution and troubleshoot any failures.
A whole chapter in the new law deals with the immunity, duties and accountability of judges.
