Firms warned against not letting employees go by delaying wages

The employers who delay payment of the financial dues of their employees to force them to continue working for them will face punishments, according to Mohammad Al Zaabi, Director of Dispute Department at the Ministry of Labour (MoL).

He told Khaleej Times recently that the employers were not allowed to delay the financial dues and wages of workers to force them to carry on work at their companies.

The clarification came after an English language teacher, M.M., filed a complaint with the ministry saying that her salary had been delayed for more than 45 days.

“The employer does not have the right to delay the wages. Moreover, since the employee (M.M.) is on probation, she has the right to leave but she must pay for the air ticket,” said Al Zaabi.

In such cases, the Dispute Department’s advisors investigate the complaint and transfer it to the Inspection Department to send notices.

“Delaying the wages is a violation of the labour law and if the delay is for more than three months, the employee has the right to transfer his/her sponsorship to another firm or employer without referring to the current sponsor,” said Al Zaabi.

In that case, the employer must pay the dues. Otherwise, the case would be transferred to the court.

Moreover, the MoL would suspend its dealings with the firm, impose a fine of Dh10,000 and downgrade its category.

The teacher said in her complaint: “The employer delayed my dues to force me to continue teaching at the English language centre to complete the course I started. However, I found the salary is low vis a vis the cost of living. Hence, I decided to stop working with the employer.”

She added that the employer demanded me to repay the fees paid for her visa, medical check-up and labour card. Source
